Free Speech and Religious Liberty Are Under Threat: Cruz warns that these arrests are part of a larger assault on First Amendment rights, where traditional American values and peaceful dissent are being criminalized by the federal government.

Senator Ted Cruz is calling out what he sees as a dangerous and deliberate effort by the Biden administration to silence and punish Americans who stand for life. Speaking on his podcast The Verdict, Cruz warned that under Biden’s Department of Justice, peaceful pro-life activists, many of them simply praying or singing outside abortion clinics, are being arrested, charged, and threatened with years in prison. According to Cruz, this isn’t about law enforcement. It’s about using the federal government to attack political opponents and criminalize dissent.
Arrests Under the FACE Act
Cruz highlighted the growing number of prosecutions under the Freedom of Access to Clinic Entrances (FACE) Act, a federal law originally intended to prevent violence or physical obstruction at abortion clinics. Under Biden, however, Cruz argues that the law is being twisted and weaponized to target people of faith.
He pointed to the case of Mark Houck, a Catholic father of seven who was arrested by the FBI in a dramatic raid on his home after an altercation outside a Planned Parenthood clinic. Houck, who was later acquitted, had only been defending his son from harassment, yet the Biden DOJ tried to make an example of him. Cruz says Houck is far from alone. Over two dozen pro-life individuals, according to conservative watchdogs, have been arrested under Biden’s DOJ, many for activities as peaceful as prayer, sidewalk counseling, or hymn-singing outside clinics.
A Double Standard in Justice
Cruz believes the pattern is clear. While pro-life Americans are being charged and jailed, attacks on pregnancy resource centers and churches have gone largely ignored. Following the leak of the Dobbs decision in 2022, dozens of pro-life centers and Catholic churches were vandalized, firebombed, or desecrated, yet Cruz says the DOJ has done little to investigate or prosecute those responsible.
This double standard, Cruz argues, sends a chilling message: if you’re on the Left, your activism is protected. If you’re on the Right, especially if you’re standing for life or expressing Christian values, you’re a target. He says this is not justice; it’s political persecution.
Suppressing Faith and Free Speech
At the heart of Cruz’s criticism is a deeper concern about the erosion of First Amendment rights. He argues that praying outside an abortion facility is not a crime, and that the Biden administration is crossing a constitutional line by prosecuting Americans for exercising their freedom of speech and religion.
He warned that this is part of a broader pattern by the Biden White House to demonize Christians, silence conservatives, and chill opposition. What used to be understood as peaceful protest or religious expression is now being rebranded as extremism or “conspiracy.” Cruz sees this as an open assault on the moral and legal foundations of the country.
A Message That Resonates with the Conservative Base
Cruz’s message resonates deeply with conservatives and Trump supporters who believe that faith, life, and liberty are under siege. The idea that praying or peacefully protesting outside a clinic could land someone in prison for a decade is seen as not only outrageous, but un-American.
The conservative base sees these prosecutions not as isolated incidents, but as part of a larger cultural and political war against traditional values. The Biden administration, in their view, is not just promoting abortion policy, it’s targeting anyone who dares to resist it, especially through peaceful, faith-driven action.
A Call to Action
On The Verdict, Cruz made it clear that this is not the time for silence. He urged Americans to stay informed, speak out, and support lawmakers who will stand up to the DOJ’s abuses. He also called for reforms to the FACE Act, ensuring it cannot be used to punish people for simply living out their beliefs.
Cruz emphasized that if the government can target someone for praying on a sidewalk, it can target anyone. He sees this issue not just as a pro-life concern, but as a defining fight for the future of freedom and faith in America.
