Legalizing the Buying and Selling of Babies

Vote Description

This bill legalizes commercial surrogacy in Michigan, meaning that it is now legal to gestate a baby inside a woman who is hired for that purpose, rather than a woman who is related to the baby or altruistically volunteers. CPAC recognizes that in most of the civilized world, surrogacy is either allowed only for altruistic reasons (Denmark, U.K., Australia), allowed only if the surrogate is a sister or cousin of the egg donor (Brazil), or banned outright (France, Germany, Norway, China). Only a handful of countries have legalized surrogacy-for-hire, and those countries typically have poor human rights records (Russia, Kazakhstan). CPAC believes that each child has a right to be connected to his or her mother and father and opposed this bill. The House passed the bill on November 9, 2024, by a vote of 56-53, and the bill later became law.
