Vote Description

This bill sponsored by Rep. Scott Fitzgerald, known as the “Separation of Powers Act,” allows courts to make decisions de novo (“without giving deference to the agency’s interpretations”) when considering matters regarding bureaucratic regulations. CPAC supports efforts to reign in bureaucratic overreach and strengthen the separation of powers within the federal government. CPAC, therefore, supported this bill. The House passed this bill on June 15, 2023 by a vote of 220-211 but the bill never became law.
