Challenging the FDA, CMS, and DOT Rules to Safeguard American Freedom and Prosperity: CRF Weekly Update

This week, the Center for Regulatory Freedom (CRF) continued its fierce advocacy for policies that empower Americans through economic freedom and innovation. With a series of comments filed on proposed federal rules, CRF is exposing federal agencies' oversteps and championing reforms that prioritize individual liberty, national security, and patient choice. From challenging FDA overreach to supporting market-driven infrastructure policies, CRF’s efforts this week reflect an unwavering commitment to rolling back regulations that stifle businesses and families, ensuring a freer, more prosperous America.
CRF’s recent filings targeted a critical range of regulatory issues. Against the FDA’s Food Traceability Rule extension, CRF argued the agency’s arbitrary “high-risk” food designations and facility mandates violate the Food Safety Modernization Act and Executive Order 14219’s cost-benefit requirements, urging HHS to reclaim authority. Similarly, CRF criticized the FDA’s overuse of Emergency Use Authorizations since COVID, calling for stricter criteria and updated guidance to curb excessive use of emergency powers.
On national security, CRF supported the Commerce Department’s Section 232 probe into wind turbine imports, highlighting how federal subsidies distort markets, raise energy costs, and expose vulnerabilities like cybersecurity risks, aligning with Executive Orders 14148 and 14315.
In healthcare, CRF pushed CMS to expand 2026 Physician Fee Schedule coverage for preventive diagnostics, eliminate barriers like prior authorization, and reduce long-term costs. For the DOT’s 2026–2030 Strategic Plan, CRF advocated preserving the Staggers Act for rail, streamlining permits, and protecting trucking’s independent contractor model. Representing CASM, CRF endorsed HRSA’s 340B rebate pilot, proposing its expansion to ensure transparency and affordability in drug pricing.
As CRF closes out another week of bold advocacy, the comments filed this week underscore a clear mission: regulations must serve the American people, not burden them. By challenging rogue agencies, promoting market-based solutions, and safeguarding economic and personal freedoms, CRF is laying the groundwork for a free and prosperous nation.
