CPAC STATEMENT ON TRUMP V. UNITED STATES - THE DECISION DOES NOT GO FAR ENOUGH
The Supreme Court in a 6-3 decision has found that Presidents are granted immunity for ‘official’ acts taken during their time in office.
In an era of lawfare by woke prosecutors and leftist plaintiffs, the decision makes perfect sense. America cannot have its commander-in-chief tied down by legal threats and litigation. Unfortunately, the decision does not go far enough.
We have seen weaponization of the law by the Left in civil and criminal cases brought by the likes of Alvin Bragg, Jack Smith, Fani Willis, and E. Jean Carroll. Today’s decision would likely not reach insulate any chief executive by motivated vengeful litigants. This is not what our Founding Fathers warned us about.
President George Washington warned in his farewell address warned: “the alternate domination of one faction over another, sharpened by the spirit of revenge natural to party dissension, which in different ages and countries has perpetrated the most horrid enormities, is itself a frightful despotism.”
Sadly, today’s decision allows President Donald J. Trump to be victimized by rogue prosecutors, hateful plaintiffs, and President Biden’s Department of Justice. The harm, however, goes beyond President Trump. We are now in a lawless era where blue states will lethality trample justice in order to get the outcome they want against any of their political opponents. Presidents of both parties could be subject to lawfare, putting our leaders and our Nation at risk.
This ruling leaves America on a dangerous path. It puts us on the same level as Brazil, China, and the Korea’s where the party in power imprisons former elected leaders as a matter of course. If Presidents can be prosecuted, what stops Republicans going after President Biden (aka “the Big Guy”), for his corruption?
It’s worth noting that Justice Clarence Thomas’ concurrence exposes the lengths the Department of Justice itself may be breaking the law in order to target President Trump. Specifically, Justice Thomas points out that Special Counsel Jack Smith is illegally appointed: “If there is no law establishing the office that the Special Counsel occupies, then he cannot proceed with this prosecution. A private citizen cannot criminally prosecute anyone, let alone a former President.”
For the past three years, we have seen the Left’s striking assault of our Republic. Under today’s Supreme Court decision, political show trials will continue.
